Sports betting became legal in the US in 2018 when the Supreme Court decided that the Professional and Amateur Sports Protection Act (PASPA) is unconstitutional. After a decade of fighting it, News Jersey was one of the first states outside of Nevada to implement legal sports betting in the USA. After that, each state was free to choose if they would allow sports betting within their borders. Out of the fifty states in the USA, only twelve have not moved to sports betting of any kind.

Is Online Sports Betting Legal in Arizona?

Arizona received its legal sports betting after its bill went through in September 2021. It was signed by Gov. Doug Ducey. Retail and online sports betting are legal in the state right now.

Legal Sports Betting: Arkansas

Since March 2022, Arkansas has had online and retail sports betting. There are only a couple of physical locations, but mobile wagering has begun with eight sportsbooks at first.

Legal Online Sports Betting in Colorado

Colorado legalized sports betting back in May 2020 and was the 19th state to do so. They have maybe the healthiest dose of sportsbook, which will create a lot of competition, which at the end of the day is good for customers.

Is Sports Betting Legal in Connecticut?

2021 was a good year for Connecticut because Gov. Ned Lamont signed the bill in May and it went live in mid-October. Their law allows three statewide mobile sportsbooks and the tribes are also allowed to open iGaming platforms.

Legal Sports Betting: Delaware

Delaware was the first to legalize sports wagering in retail locations after the fall of PASPA, but that is just about all they have done since then. Mobile and online sports wagering are still unavailable in the state.

District of Columbia: Online Wagering

May 2020 was the month when sports betting launched in DC. Capital One Arena is the first professional sports venue with a sportsbook inside that was launched a year later. The DC Lottery is controlling the online sports betting situation in the state.

Illinois has both physical and mobile wagering available right now and they have seven legal sportsbooks already with more coming in the future.

Indiana: Legal Sports Betting Details

Legal sports betting began in Indiana in 2019 with DraftKings and FanDuel but has since grown and now they have a healthy dose of sportsbooks to offer customers.

Before 2021, bettors had to sign-up in person in any of the Iowa casinos, but as of that year, it is no longer necessary. Online sports betting is legal and available 100% online.

Louisiana: Legal Sports Betting

The end of January 2022 was the golden date for legal sports betting in Louisiana. That’s six months after Gov. John Bel Edwards signed the bill into law, which allowed a maximum of 41 sportsbooks to operate in the state with six starting on the first day.

On November 23, 2022, online sportsbooks began offering Maryland sports betting. There are a variety of places in Maryland, including off-track betting facilities, casinos, and other establishments, where you can access a sportsbook on your mobile device or in person. People in Maryland can wager on every major sports league. The MLGCA or the Maryland Lottery and Gaming Control Agency is in charge of licensing and regulating Maryland ONLINE sports betting, along with Maryland’s five casinos and lottery operations. In addition to the MLGCA, the SWARC or the Sports Wagering Application Review Commission has a hand in approving sports betting licenses.

Michigan received legal sports betting and fantasy sports on the same day in December 2019. Online wagering was launched in January 2021.

Mississippi Wagering Rules and Laws

Mississippi is one of the three states to legalize sports betting the fastest after Delaware and New Jersey in August 2018. Mobile wagering is still illegal though unless you are inside one of their casinos.

Is Online Betting Legal in Montana?

Montana customers can only enjoy legal sports betting at retail locations in the state since March 2020. It’s run by the state lottery and we don’t know of any plans to launch online or mobile wagering in the state. There is a mobile app, but you can only use it in retail locations.

Sports Betting in Nevada

Nevada has had legal sports betting since 1949. There are numerous mobile apps available throughout the state, but you would have to register in person at a casino to use them.

Legal Online Sports Betting in New Hampshire

New Hampshire legalized online and mobile wagering in 2019, but it went live in 2020 with DraftKings as the solo operator available. Even now, you can only place bets online via DraftKings.

New Jersey: The Head of the Sports Betting Movement

The Garden State, New Jersey, was one of the first ones to legalize online and retail sports betting after Delaware. Now, there are a lot of operators you can choose from in the state with more coming every day.

New Mexico: Is Online Sports Betting Legal?

Sports betting went live in October 2018, but only because of a loophole some tribal casinos used to launch retail sportsbooks. Online and mobile wagering is still dead in the water though because most lawmakers are still severely against them.

Retail betting went live in 2019, but online betting in New York became available in the Empire State in 2022 in advance of the Super Bowl LVI.

Fantasy sports are available in the state, but online sports betting was delayed by at least a year when bill SB 688 (a bill that would have legalized up to 12 mobile wagering apps) was voted against with 50-51 votes.

Is Wagering on Sports Legal in North Dakota?

There haven’t been any bills passed regarding legal sports betting in the state, but a few tribal casinos opened retail sportsbooks in 2021. There is no online or mobile wagering available, and it doesn’t look like there will be for some time.

Oregon’s only legal sports betting option is run by the state lottery, but sports betting itself launched way back in 2019.

In the case of Ohio, the state has legalized sports betting. HB 29, an act legalizing sports betting in Ohio, was approved by the state’s legislature and signed into law by Governor Mike DeWine on December 22, 2021. On January 2023, the market officially opened for both offline and online betting establishments. Ohio sports betting is poised to become a major sports betting hub after the state was awarded 25 Type A sports betting licenses, making room for as many as 50 internet sportsbooks. Pennsylvania: Legal Sports Betting Online

Thanks to the size of Pennsylvania and its many sports fans since its launch in 2019, online sports betting has had a lot of opportunities in the Keystone State.

Rhode Island Online Wagering Laws

Retail and mobile wagering are currently legal and available in Rhode Island. You can place a bet in person in both casinos in the state however mobile wagering is currently limited to Caesars Sportsbook only via IGT’s platform.

South Dakota: Is Online Betting Legal?

Some sports betting regulations were approved and launched by lawmakers in August 2021, and in the fall, online and physical wagering was launched only in approved retail locations in Deadwood casinos.

Tennessee is one of the few states that only offer online wagering as an option. It was launched in November 2020 with odds from some of the big names in sports betting available.

Virginia also launched fully online sports betting within its borders, but there is some hope of opening physical sportsbooks, too, soon.

In-person wagering was launched just in time for the 2021 NFL season in Washington. You can place mobile bets in the state but you will have to be located at one of the physical locations to do it.

West Virginia Sports Betting Rules

Legal sports bets were being taken back in August 2020 in West Virginia. Both physical and mobile wagering is permitted in the state.

Wisconsin Legal Online Sports Betting

Only physical sports betting is available in Wisconsin right now as of November 2021. Nine different locations offer it to customers of the state and your first deposit has to be made in person in one of the locations. Also, you have to be there in person to place mobile bets.

Is There Legal Sports Betting in Wyoming?

It was a surprise but mobile wagering was approved in September 2021 just in time for the NFL season. DFS is also available in the state.

 

Which States Have Taken the First Sports Betting Steps?

There are some states where it has been decided that sports betting online or in retail locations would be launching soon, but the actual time for the launch hasn’t exactly come yet.

  • Nebraska – a launch is expected in late 2022, but potential changes in the law are delaying the launch after the legislature was approved in 2021.
  • Kansas – Gov. Laura Kelly signed the bill that would approve in-person wagering and up to 12 sportsbooks in March 2022 and now it’s just a waiting game for the launch. It is estimated that at the beginning of next year sports betting would be available in the state but it could be sooner.
  • Ohio – the date for online sports betting apps and in-person wagering is set for January 2023. The bill was signed by Gov. Mike DeWine in 2021, which will allow up to 46 different operators in the state.
  • Maine – Gov. Janet Mills signed the bill that would legalize sports betting and give control over the Native American tribes in Pine Tree State in May 2022. The launch itself will take some time and you can either expect it in late 2023 or early 2024.

We will mention four other states that have passed some sort of bill or legislature, but it is still waiting for approval by all the lawmakers.

  • California – Upcoming referendum during November 2022 elections to decide.
  • Florida – There won’t be legal sports betting at least until 2023 unless it comes via legislation or referendum
  • Alabama – Bill SB 294 is heading to State Senate for approval in fall 2022.
  • Massachusetts – In April State Senate passed SB 2844, but now the lawmakers need to see what the main differences between that and the bill passed last summer by the House are before heading to the governor’s desk.

Illegal Sports Betting in the USA

Not all US states approve sports betting whether it’s online or in person at retail locations. Besides the states with online sports betting and those with physical wagering only, there are twelve states where it is still illegal to place any kind of wagers. Here are the twelve states we were talking about:

  • South Carolina
  • Texas
  • Utah
  • Vermont

In some of these states, some bills had been passed, but not approved by everyone. There are also states where sports betting bills weren’t even drafted in the first place because people are against this. We will update this section with any news if any of these states change their minds or if any future attempts at passing bills succeed.

Summary of Legal Sports Betting in the USA

With fifty states come fifty different ways and timetables of legalizing sports betting across the US. Although the striking of the PASPA bill opened the door for each state to decide on its own, there are still some that completely disagree with sports betting of any kind whether online or in person.
